1. Agreement to Terms

These Terms & Conditions ("Terms") govern your purchase and use of website design, hosting, and related services from Launch Smart Sites, a service of Premier Media Services Inc. ("Launch Smart Sites," "we," "us," or "our"). By purchasing a plan, submitting payment, or using our services, you ("you," "your," or "Client") agree to be bound by these Terms.

If you do not agree to these Terms, please do not purchase or use our services.

2. Services We Offer

Launch Smart Sites offers four service plans, each described in detail on our pricing page at the time of purchase:

The specific features included in your plan are those listed on the pricing page at the time you purchased, or as later modified under Section 14.

3. Fees, Billing & Pricing Changes

3.1 Setup Fee

A one-time setup fee applies at signup, as listed on the pricing page for your plan. This fee covers initial site build and configuration and is non-refundable except as described in Section 6 (Money-Back Guarantee).

3.2 Monthly Fee

Your plan is billed monthly in advance, starting on the date your site is delivered or your account is activated, whichever comes first. Monthly fees cover hosting, maintenance, and the support described in Section 5.

3.3 Limited-Time / Promotional Pricing

Prices marked as limited-time or promotional reflect a discount from our standard rate. If you sign up at a promotional rate, that rate is locked in for as long as your account remains active and in good standing — we will not increase your monthly rate without at least 30 days' written notice (email is sufficient), and any increase will only apply going forward, never retroactively.

3.4 Growth Plan Usage Charges

The Growth plan includes a phone number, call/text volume, and AI voice minutes billed at cost, in addition to the flat monthly fee. Estimated usage ranges are shown on the pricing page; actual usage-based charges will appear as a separate line item and vary based on your business's call and text volume.

3.5 Late or Failed Payment

If a payment fails, we will attempt to notify you and retry the charge. See Section 7 for what happens if payment issues aren't resolved.

4. Website Build & Delivery

We aim to deliver Launch, Plus, and Ecommerce sites within 7 business days of receiving the information needed to build your site (business details, logo/branding assets if applicable, and any specific content requests). Delivery timelines depend on how quickly you provide the information we need — delays on your end will extend the delivery timeline accordingly.

Core pages (About, Contact, Privacy Policy, Disclosure, and Terms of Use) are generated using our AI Site Wizard based on the business description you provide at signup. You're responsible for reviewing this content for accuracy before your site goes live, and you can request edits to it at any time under Section 5.

5. Edits & Ongoing Support

5.1 What Counts as an Edit

An "edit" is a reasonable, minor update to your existing site, including:

• Updating text, prices, hours, phone numbers, or addresses
• Swapping out existing images
• Adding or fixing a form field, embed, or broken link
• Minor styling or layout adjustments to existing pages

The following are not included as edits, and will be quoted separately: building new pages beyond what's included in your plan, full redesigns, custom code or plugin development, adding online store functionality (unless you're on the Ecommerce or Growth plan), and any project that would reasonably take more than about 30 minutes of work.

5.2 Launch Plan — Included Edits

The Launch plan includes a monthly site health check (uptime, update status, security scan, and a test of your lead forms) plus 2 included edits per month. Unused edits do not roll over to the next month. Additional edits beyond the included 2 can be purchased at a flat rate of $30 per edit.

5.3 Plus, Ecommerce & Growth — Unlimited Edits

These plans include unlimited done-for-you edits as defined in Section 5.1, subject to fair use. "Unlimited" means we won't cap the number of qualifying requests you send us in a month — it does not mean unlimited hours of custom development, new page builds, or ongoing "design by a hundred small emails" in place of a real content plan. If your requests consistently fall outside the scope in Section 5.1, we'll let you know and offer a project quote instead.

5.4 Turnaround Time

We respond to support and edit requests within 48 hours on Launch, or 24 hours on Plus, Ecommerce, and Growth. Most edit requests are completed within 3–5 business days of being submitted, depending on complexity and current volume.

6. Money-Back Guarantee

If you're not satisfied with your website within 30 days of delivery, we'll refund your monthly hosting fee for that period. The one-time setup fee is non-refundable once work has begun, except where your site was not delivered within a reasonable time through no fault of your own. To request a refund under this guarantee, email us within the 30-day window — see Section 16.

7. Cancellation & Non-Payment

7.1 Cancelling Your Plan

You may cancel at any time by emailing us. Cancellation takes effect at the end of your current billing cycle — we don't charge you again after that, and we don't provide partial-month refunds for the cycle already in progress.

7.2 Non-Payment

If a monthly payment fails and isn't resolved within 14 days, your site will be temporarily suspended. If payment is not brought current within 90 days of suspension, we reserve the right to permanently remove your site and associated files from our hosting.

7.3 What Happens to Your Site When You Leave

Upon cancellation (for any reason), you may request an export of your site's content and a copy of your page content for a reasonable administrative fee. Because our plans use licensed premium themes and plugins, the exact build (theme license, page-builder configuration) may not be transferable to another host as-is — your content, images, and copy are yours regardless.

8. Domain Names

Where possible, your domain name is registered in your name and under your own account, so it remains fully yours regardless of your relationship with us. If we register or manage a domain on your behalf, we will disclose this clearly, and you may request transfer of that domain to your own account at any time at no additional charge beyond the registrar's standard transfer fee, if any.

9. Content & Ownership

You own the content you provide us (text, images, logos, business information) and the written content we create for your site based on your input. Licensed themes, plugins, and page-builder templates used to construct your site remain licensed to us and are provided to you as part of the hosted service — they are not sold to you outright and may not be extracted for use outside your Launch Smart Sites account.

10. Ecommerce-Specific Terms

Ecommerce and Growth plans include payment processing configured through third-party processors (such as Stripe). You are responsible for maintaining your own merchant account in good standing, complying with applicable sales tax and consumer protection laws in the jurisdictions where you sell, and any fees charged directly by the payment processor. We configure the store and payment integration but are not a party to transactions between you and your customers.

11. Growth Plan (GoHighLevel Platform) Terms

The Growth plan runs on the GoHighLevel platform rather than WordPress/Hostinger. Your use of the CRM, calendar, AI voice agent, and messaging features is also subject to GoHighLevel's own terms of service and acceptable use policies, and to carrier requirements for business texting (such as A2P 10DLC registration). Usage-based charges for phone numbers, calls, texts, and AI voice minutes are billed at cost and are separate from your flat monthly fee.

12. Uptime, Liability & Disclaimers

We work to keep your site online and secure, but we do not guarantee 100% uptime — our hosting depends on third-party infrastructure (Hostinger, GoHighLevel) outside our direct control. To the fullest extent permitted by law, our total liability to you for any claim arising from these services is limited to the amount you paid us in the 3 months prior to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business, arising from website downtime, third-party service outages, or content errors.

13. Acceptable Use

You agree not to use our services to host or publish content that is illegal, defamatory, fraudulent, or infringes on the rights of others. We reserve the right to refuse service, suspend, or remove content that violates this section or the acceptable use policies of our underlying hosting and platform providers.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll notify active clients by email at least 14 days before it takes effect. Continued use of our services after that date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Brevard County, Florida.
