1. Agreement to Terms

These Terms & Conditions ("Terms") govern your purchase and use of website design, hosting, and related services from Launch Smart Sites, a service of Premier Media Services Inc. ("Launch Smart Sites," "we," "us," or "our"). By purchasing a plan, submitting payment, or using our services, you ("you," "your," or "Client") agree to be bound by these Terms.

If you do not agree to these Terms, please do not purchase or use our services.

2. Services We Offer

Our current plans are described on the pricing page at the time of purchase:

The specific features included in your plan are those listed on the pricing page at purchase or otherwise agreed in writing. Existing legacy plans, including Plus, retain their agreed service scope unless separately changed under Section 14.

3. Fees, Billing & Pricing Changes

3.1 Setup Fee

The one-time setup fee is paid at signup: $99 for Smart Website, $499 for Ecommerce Website, and $499 for Business Lead System. It covers initial setup and configuration and is non-refundable except as described in Section 6.

3.2 Monthly Fee

Monthly service is billed in advance beginning when your website or system launches. Smart Website is $49/month at the founding rate or $79/month at the regular rate. Ecommerce Website is $129/month. Business Lead System is $199/month. Setup payment or account creation alone does not start monthly service billing.

3.3 Smart Website Founding Price

The $49/month Smart Website founding rate is retained only while your subscription remains continuously active and in good standing. New Smart Website subscriptions at the $49 founding rate have an initial three-month minimum beginning when the website launches, then continue month-to-month. Cancellation follows Section 7. If you cancel and later return, the regular $79/month rate applies; the founding rate is not reinstated. Existing clients retain the service term agreed at purchase; the new minimum is not imposed retroactively.

3.4 Business Lead System Usage Charges

The Business Lead System plan includes a phone number, call/text volume, and AI voice minutes billed at cost, in addition to the flat monthly fee. Estimated usage ranges are shown on the pricing page; actual usage-based charges will appear as a separate line item and vary based on your business's call and text volume.

3.5 Late or Failed Payment

If a payment fails, we will attempt to notify you and retry the charge. See Section 7 for what happens if payment issues aren't resolved.

4. Website Build & Delivery

We aim to deliver Launch, Plus, and Ecommerce sites within 7 business days of receiving the information needed to build your site (business details, logo/branding assets if applicable, and any specific content requests). Delivery timelines depend on how quickly you provide the information we need — delays on your end will extend the delivery timeline accordingly.

Core pages (About, Contact, Privacy Policy, Disclosure, and Terms of Use) are generated using our AI Site Wizard based on the business description you provide at signup. You're responsible for reviewing this content for accuracy before your site goes live, and you can request edits to it at any time under Section 5.

5. Edits & Ongoing Support

5.1 What Counts as an Edit

An "edit" is a reasonable, minor update to your existing site, including:

• Updating text, prices, hours, phone numbers, or addresses
• Swapping out existing images
• Adding or fixing a form field, embed, or broken link
• Minor styling or layout adjustments to existing pages

The following are not included as edits, and will be quoted separately: building new pages beyond what's included in your plan, full redesigns, custom code or plugin development, adding online store functionality (unless you're on the Ecommerce or Business Lead System plan), and any project that would reasonably take more than about 30 minutes of work.

5.2 Smart Website — Included Changes

Smart Website includes a monthly website health check and up to 15 minutes of minor content changes monthly. Unused time does not roll over. Additional changes, new pages, redesigns and custom functionality are quoted separately.

5.3 Ecommerce Website & Business Lead System — Included Changes

Ecommerce Website includes up to 30 minutes of minor content or product changes monthly. Business Lead System includes up to 30 minutes of minor website or form changes monthly. Unused time does not roll over. Additional product entry, custom integrations, ongoing store management and major changes are separately quoted. Existing legacy Plus service follows the scope agreed at purchase.

5.4 Support Response Targets

Smart Website email support has a two-business-day response target. Ecommerce Website and Business Lead System have a one-business-day priority response target. Most qualifying edit requests are completed within 3–5 business days, depending on complexity and workload.

6. Refunds and 30-Day Limited Guarantee

If you are not satisfied with your website or system, email [email protected] within 30 days of delivery to request a refund of the first monthly service fee actually paid for that website or system. This limited guarantee applies to Smart Website, Ecommerce Website, and Business Lead System. Monthly billing begins at launch; no monthly-fee refund is due if no monthly fee has been paid.

Setup fees are non-refundable once work begins, except where your website or system was not delivered within a reasonable time through no fault of your own, or where required by law.

The 30-day guarantee does not cover setup fees, usage-based charges for phone, text, email or AI services already used, or third-party fees. Outside this limited guarantee, monthly fees are non-refundable for a billing period that has begun, and no partial-month refunds are provided.

A refund request does not itself cancel your service or waive remaining charges under an agreed minimum term. To cancel, follow the cancellation procedure and effective dates stated in Section 7 and your service agreement.

If you were charged twice, charged the wrong amount, or charged after a cancellation we confirmed, we will correct it and refund the amount in question.

7. Cancellation & Non-Payment

7.1 Cancelling Your Plan

Smart Website: New subscriptions at the $49 founding rate have an initial three-month minimum beginning when the website launches. A cancellation requested during this minimum takes effect at its end; service and monthly billing continue through that term. Afterward, cancellation takes effect at the end of the current billing period. Email us to cancel. Cancelling ends eligibility for the $49 founding rate; returning clients pay the regular $79/month rate. Existing clients retain the service term agreed at purchase.

Ecommerce Website: Cancel anytime by emailing us. Cancellation takes effect at the end of your current billing period, after which no further monthly service charges apply.

Business Lead System: New subscriptions have an initial three-month minimum beginning when the system launches, then continue month-to-month. A cancellation requested during the initial minimum term takes effect at its end; service and monthly billing continue through that term. After the minimum term, cancellation takes effect at the end of the current billing period. The initial period allows time for onboarding, texting registration where required, configuration and an initial performance review; it does not guarantee leads, sales or other business results.

Existing Business Lead System subscriptions retain the minimum term agreed at purchase unless a change is separately agreed; the new three-month minimum is not imposed retroactively. We do not provide partial-month refunds for a billing period already in progress, subject to Section 6. Setup-fee refund provisions are also governed by Section 6.

7.2 Non-Payment

If a monthly payment fails and isn't resolved within 14 days, your site will be temporarily suspended. If payment is not brought current within 90 days of suspension, we reserve the right to permanently remove your site and associated files from our hosting.

7.3 What Happens to Your Site When You Leave

Upon cancellation (for any reason), you may request an export of your site's content and a copy of your page content for a reasonable administrative fee. Because our plans use licensed premium themes and plugins, the exact build (theme license, page-builder configuration) may not be transferable to another host as-is — your content, images, and copy are yours regardless.

8. Domain Names

Where possible, your domain name is registered in your name and under your own account, so it remains fully yours regardless of your relationship with us. If we register or manage a domain on your behalf, we will disclose this clearly, and you may request transfer of that domain to your own account at any time at no additional charge beyond the registrar's standard transfer fee, if any.

9. Content & Ownership

You own the content you provide us (text, images, logos, business information) and the written content we create for your site based on your input. Licensed themes, plugins, and page-builder templates used to construct your site remain licensed to us and are provided to you as part of the hosted service — they are not sold to you outright and may not be extracted for use outside your Launch Smart Sites account.

10. Ecommerce-Specific Terms

Ecommerce and Business Lead System plans include payment processing configured through third-party processors (such as Stripe). You are responsible for maintaining your own merchant account in good standing, complying with applicable sales tax and consumer protection laws in the jurisdictions where you sell, and any fees charged directly by the payment processor. We configure the store and payment integration but are not a party to transactions between you and your customers.

11. Business Lead System (GoHighLevel Platform) Terms

The Business Lead System plan runs on the GoHighLevel platform rather than WordPress/Hostinger. Your use of the CRM, calendar, AI voice agent, and messaging features is also subject to GoHighLevel's own terms of service and acceptable use policies, and to carrier requirements for business texting (such as A2P 10DLC registration). Usage-based charges for phone numbers, calls, texts, and AI voice minutes are billed at cost and are separate from your flat monthly fee.

12. Uptime, Liability & Disclaimers

We work to keep your site online and secure, but we do not guarantee 100% uptime — our hosting depends on third-party infrastructure (Hostinger, GoHighLevel) outside our direct control. To the fullest extent permitted by law, our total liability to you for any claim arising from these services is limited to the amount you paid us in the 3 months prior to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business, arising from website downtime, third-party service outages, or content errors.

13. Acceptable Use

You agree not to use our services to host or publish content that is illegal, defamatory, fraudulent, or infringes on the rights of others. We reserve the right to refuse service, suspend, or remove content that violates this section or the acceptable use policies of our underlying hosting and platform providers.

14. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we'll notify active clients by email at least 14 days before it takes effect. Continued use of our services after that date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Brevard County, Florida.
